Chapter 1 in Compliance by Design in AI Systems, 2026, pp 1-18 from Edward Elgar Publishing
Abstract:
This chapter introduces the concept of “by design” requirements in law and regulation. The chapter analyses how various “by design” requirements, such as privacy by design and security by design, relate to AI regulation. The chapter argues that AI systems trained on personal data would be required to respect data protection by design and that one manner to comply with the AI Act, the GDPR, and cybersecurity regulations concurrently when developing and deploying AI systems is to shift compliance with these regulations earlier (left) in the development and deployment methodologies. Moreover, the current chapter explains the research questions that are analysed in the book and the research methodology and outlines the remaining chapters of the book.
