Abstract: The Introduction sets out the three questions that the book seeks to address: 1) do IHL and IHRL require an independent and impartial review of NIAC detention?; 2) if so, what are the minimum legal requirements under IHL and IHRL for an independent and impartial review board to review detention in relation to a NIAC?; and finally 3) what should an independent and impartial review board look like in practice from a normative perspective to ensure the minimum legal requirements under IHL and IHRL are met?
