Chapter 13 in The European Insolvency Regulation, 2026, pp 129-134 from Edward Elgar Publishing

Abstract: Reaching beyond jurisdiction and coordination, the EIR also embeds mechanisms ensuring lawful information handling and transparency of proceedings across Member States. It introduces a system for data protection, aligning cross-border insolvency practice with the Union's modern privacy regime. It also establishes an interconnected system of national insolvency registers and standardised forms, to secure open, accurate, and accessible information for practitioners and creditors. These provisions modernise the procedural infrastructure of European insolvency law and reflect the Union's broader digital and rights-based orientation. Data protection is governed by the General Data Protection Regulation 2016/679 (GDPR), which establishes a single, directly applicable system of rules throughout the Union. To ensure interconnection of registers, the EIR 2015 imposes publicity obligations and minimum data content requirements for the national registers that are maintained by Member States and connects them through the central European e-Justice Portal. The standard forms are contained in Commission Implementing Regulation 2017/1105.
