Abstract: The commitment to fixed book prices by law in Germany intents a protection of a variety of cultural aspects associated with producing and reading books. However the underlying line of arguments is based on diverse assumptions concerning for instance cross-subsidizing and resale infrastructure which are seriously questionable. The attainment of the political aims of the resale price maintenance system is now contained in the new german law as guaranties for a great variety of literal work and conservation of a tight network of small resalers offering books lies beyond the possibilities and impact of the legislative kind of regulation. From a legal perspective also the former nonconformity with European Law complained by the European Commissioncould be 'solved' only on the basis of opening the system due to exeptions for books from other European Union Member States resulting in a dilution of the intended homogeneity and fairness of the whole resale price maintenance system.
