Abstract: Abstract This chapter provides a comprehensive analysis of the European patent system and the current challenges surrounding the quality of patents. Patents are an essential element of economic growth that foster innovation through the generation of new scientific and technological knowledge. The impact of patents to spur innovation and economic growth in Europe has been clearly stated by the European Commission and Council (e.g. European Commission, 2008; Council of the European Union, 2009). The Lisbon Agenda of the European Council also stresses the role of IP protection for advancing European competitiveness and growth. Patents continue to be used increasingly by private companies and public research organisations to protect new inventions, which have created new waves of innovation and prompted shifts within the legal and regulatory framework of patent regimes (OECD, 2004). However, the emergence of new technologies and the increase of patent applications have all impacted the IP regulatory framework and the ability of patent examiners to issue high-quality patents.
