A chapter in Transparency in FinTech, 2025, pp 87-117 from Palgrave Macmillan
Abstract:
Abstract This chapter explores the dynamic interaction between regulatory sandboxes, financial technologies (FinTech), and EU competition law. As traditional regulatory frameworks adapt to the digital age through measures like the Digital Markets Act (DMA), which imposes ex-ante obligations on gatekeepers, this analysis investigates whether regulatory sandboxes provide a more flexible and innovation-friendly approach to governing FinTech markets. By examining their potential, the chapter aims to evaluate whether sandboxes can effectively balance the need for fostering innovation while ensuring fair competition in the fast-evolving landscape of digital finance.
