Abstract: Abstract Imprisonment has existed since antiquity. The famous Code of Hammurabi in Mesopotamia mentions imprisonment for debtors (interestingly, the confinement is to be done by the creditor, not the State) with penalties for the creditor in case of mistreatment of the debtor (see, e.g., Ancient Origins, Prisons and imprisonment in the ancient world: punishments used to maintain public order, 2020). As pointed out by Al-Khatib (Doing time: a history of US prisons, 2015), the concept of imprisonment as punishment was not regularly used in Europe and North America. Jails, as temporary holding cells, were a different story. The first prison in the United States was the then path-breaking Eastern Penitentiary Prison in Philadelphia was built in the 1820s. That prison also pioneered the “separate system,” i.e., solitary confinement as a means to reflect upon the crimes that had been committed (penance, the origin of the term penitentiary), until overcrowding of prisons put an end to this practice.
