Abstract: Abstract As the United States Department of Agriculture considers a coexistence policy, this chapter discusses three facets of the policy that appear to be under-explored. These three facets are: The National Environmental Policy Act, the mitigation-of-damages doctrine, and the benefit rule from the common law. The chapter urges careful and thoughtful attention and discussion about each of these three facets.
