Abstract: Abstract The win rate of plaintiffs in EEO cases is much lower than in other civil cases. This chapter argues that the undervaluing of statistical evidence by courts is a contributing factor. Even when plaintiffs win, the current method of estimating the shortfall in positions they deserve leads to an underestimate of monetary damages and an alternative is proposed.
