Chapter Chapter 6 in Corporate Debt Restructuring in Emerging Markets, 2021, pp 139-158 from Springer
Abstract:
Abstract The fox has finally been convinced to flee to a mountain-side refuge, where all the remaining animals of the forest, large and small, have fled. Before he is allowed to join the rest, the fox must agree to respect the others. In the same way, once the decision to begin the restructuring has been taken, an orderly process requires a shared vision of the objectives and the process. This chapter discusses the consideration around: (i) the establishment and governance of the lenders’ group; (ii) work plan and timetable; (iii) engagement of professional advisors; (iv) standstill and other pre-negotiation letters; and (v) group assignments. To reinforce the learnings, the discussion returns to just the manufacturing case study. The chapter ends with a set of key learnings, using again the opening Bank of Commerce tale.
