Abstract:
Abstract In this case the Plaintiff, Ms. Traci Stevenson, worked for a public utility employer as its General Counsel. Ms. Stevenson alleged she was terminated for discriminatory reasons. Approximately two years after Ms. Stevenson’s termination, she obtained employment with a legal staffing agency. An analysis of the Plaintiff’s job search efforts and of the labor marketLabor market for individuals with Ms. Stevenson’s knowledge, expertise and skills were performed. It was found that Ms. Stevenson did not perform an adequate job search relative to the job market available to her. Ms. Stevenson’s job search was sporadic, inconsistent, and did not accurately represent the opportunities that were available to her. Ms. Stevenson additionally claimed defamation by her employer hindered her employer opportunities. Ms. Stevenson’s job search records and deposition testimony from Ms. Stevenson revealed no indication that comments made by her employer had reduced her ability to obtain employment.
