Abstract: Abstract The mining industry has been and is essential to the economy of South Africa. The transformation agenda was an attempt to transform the industry to reflect the demographics of the country. However, the time frames required appear inappropriate, with poor monitoring and support from government. With the initial Mining Charter achieving mixed results, government implemented upgraded versions of the Charter as government expectations were not met, creating uncertainty of regulation. Communities have also clashed with government to exert their rights or to seek benefits from mining. Government sought to exert authority over communities to the extent of ignoring court judgments, often using a development agenda, even where no benefits would accrue to communities from mining. It is perhaps opportune for an in-depth assessment of the South African mining industry with a view of establishing and implementing a new mineral policy.
