Abstract:
Abstract This chapter addresses the conditions that favored the rise of patent intermediaries. A key differentiating element of this chapter is its proposed approach to the main functions of patent intermediaries. Our view differs from the predominant classical explanation of the emergence of patent intermediaries. We argue that patent intermediaries were not a mere vehicle for alleviating the failures inherent in the market for patents. Rather, they were a key component of the rising market for patents. In the early stages of the market, the main purpose of intermediation was to connect separate entities. Patent agents and attorneys served as intermediaries due to their personal and professional networks. To use a simple metaphor, they were mere “matchmakers.” Over time, patent intermediaries have evolved to become “market-makers” that perform a wide range of added-value functions instrumental to the successful functioning of the market for patents.
