Abstract: Abstract Notwithstanding the harem of legal provisions governing employment matters in Nigeria, the contractual relationship between the employer and employee has been one that is plagued with different contentions ranging from employer liability to employee duties and resolution of incidental conflicts. Our courts have continued to receive endless and several petitions bothering employment matters demanding varied answers to different issues all for the purpose of securing justice to needless but perceived or experienced acts of injustice in the course of parties carrying out their lawful endeavours. Therefore, this chapter seeks to examine the nature of employment and arising operational conflicts in Nigeria vis-à-vis the impact of the legal framework governing that relationship. This chapter further interrogates the operations of the employment relationship in Nigeria with regard to possible causes of contention and adverse effects on efficiency and performance. This study applied an analytical research method to obtain the opinions and data presented in this chapter. Several provisions of the Nigerian law governing employment matters are X-rayed with the intent of examining their effectiveness and ineffectiveness in handling employment relationship contentions. In the final analysis, this chapter fosters suitable recommendations that can possibly improve the employer and employee relationship under Nigerian law.
