Chapter Chapter 4 in The European Banking Regulation Handbook, Volume I, 2023, pp 201-267 from Springer
Abstract:
Abstract This chapter first briefly presents financial integration as the conceptual basis of EU financial law, gives the definition of EU banking law and its position within the system of EU financial law and examines its delimitation vis-à-vis (mainly) EU monetary law. It then systemically develops on the first three periods in the evolution of EU banking law (including on the creation of the European System of Financial Supervision (ESFS)) and on the current fourth period, until the creation of the (European) Banking Union (BU) for the Member States participating therein. The final section elaborates on the creation of the BU, on its two key pillars in place, namely the Single Supervisory Mechanism (SSM) and the Single Resolution Mechanism (SRM), on the (still) missing third pillar (namely the European Deposit Insurance Scheme (EDIS)), as well as on the legislative acts which constitute the single rulebook in EU banking law.
