Abstract: Abstract The focus of this chapter is on developments in EU banking (and capital markets) law upon the establishment of the BU. It first examines the implementation of the Commission’s 2016 reform agenda (“legislative banking package”), including the substantial amendment of legislative acts that constitute the sources of EU banking law, and the creation of the ‘common backstop’ to the Single Resolution Board (SRB) for the Single Resolution Fund (SRF). Then, the Capital Markets Union (CMU) is discussed, based on the Commission’s 2015 “CMU Action Plan”, with emphasis on the sustainable finance agenda. The following section systematically presents the measures adopted by EU institutions (including the European Central Bank (ECB)) and EU agencies (the European Banking Authority (EBA), the European Systemic Risk Board (ESRB) and the SRB) amidst the current pandemic crisis. The chapter concludes with an overview of current developments relating, inter alia, to sustainable and digital finance.
