Abstract: Abstract The reform of collective land use system plays an important role in promoting the reasonable use of agricultural land and constructing the new countryside. As a special commodity under market economy, land resources are regulated by the market mechanism. Non-standard transferring may result in the illegal occupation of large amounts of agricultural land. Though China’s laws has made strict restriction and regulation on the transfer of the use right of collective construction land, there are also some problems in practice, such as the illegal occupation of collective land and the existence of hidden price in the land market. The establishment of the market mechanism of the transfer of land use right can effectively standardize the land transaction market, achieve the marketization of the transfer of land use right and reach the goal of the land use system.
