Abstract: Zusammenfassung Das System des Rücktrittsrechts im BGB ist dem System des Schadensersatzrechts sehr ähnlich. Man kann sagen, dass das Rücktrittsrecht regelmäßig dann gegeben ist, wenn auch ein Anspruch auf Schadenersatz statt der Leistung gegeben ist (§§ 281, 323 BGB).
