Abstract: ZusammenfassungDie USA verfügen über ein besonders strenges Exportkontroll- und Sanktionssystem, das unter bestimmten Voraussetzungen auch auf europäische Unternehmen Anwendung findet. Zwar richten sich diese Regelungen primär an US-Personen, sie werden in der Praxis jedoch häufig extraterritorial auf Nicht-US-Unternehmen erstreckt. Maßgeblich sind die Export Administration Regulations (EAR), die International Traffic in Arms Regulations (ITAR) sowie die vom Office of Foreign Assets Control (OFAC) verwalteten Sanktionsprogramme. Verstöße können erhebliche Sanktionen bis hin zum Ausschluss vom US-Markt nach sich ziehen.
