Abstract:
Abstract Business information, especially trade secrets, has always been the most crucial asset of a company, and therefore requests special protection. Indeed, Chinese labour laws have offered enterprises a legal instrument, the non-compete agreement, to prevent former employees from leaking such information and forming malevolent competition. This article analyses the pros and cons of current legal framework for non-compete agreement in China, and provides a number of “good practices” to enhance information management through non-compete agreement.
