Abstract: Zusammenfassung Immer mehr Software wird agil entwickelt, mit Methoden wie Scrum, Kanban oder eXtreme Programming. Die rechtliche Einordnung wird unter Juristen noch diskutiert. Als überwiegende Auffassung hat sich wohl herausgebildet, dass bei der Vertragsgestaltung jeder einzelne Sprint als einzelner Werkvertrag41 zu behandeln ist. Dennoch passt das rechtliche Konzept des Werkvertrags nicht genau, da beim Werkvertrag ein vorher definierter Erfolg geschuldet ist, den es beim einzelnen Sprint so nicht gibt. Auch liegt bei agiler Softwareentwicklung mehr (Mit-)Verantwortung beim Anwender.
