Abstract:
Abstract After the discovery of a compliance violation, the excitement in the company is great. Not least because of increasing reputation losses and penalties, the management takes active interest, the legal department strives to limit the damage, the internal audit strives for the exact determination and the future avoidance of such incidents. The penalty plays a very important role for the affected person, even more for the uninvolved, who will only report compliance violations in the future if they consider the penalty to be fair. How this penalty is determined is shown in the following text. The process ends with the handling of the delinquent, where proportionality should take precedence over mercilessness.
