Abstract: Abstract Horizontal agreements between competitors are normally associated with cartels but can refer to any anti-competitive agreements. Vertical agreements on the other hand are usually efficiency enhancing. In this chapter the clauses of Section (3)(3) horizontal agreements and Section (3)(4) on vertical agreements are examined with decisions of the Competition Commission of India applying the economic tools of analysis of Chapter 2. Game theoretic strategizing using simple Nash equilibrium raises the doubt “did we get it right”? Resetting of standards and designing of trigger mechanism emerge from the analysis.
