Abstract:
In recent years, China has accelerated the development of recycling systems and the infrastructure for new energy vehicle power batteries, issuing a series of administrative regulations, rules, and other normative documents. However, a comprehensive legal framework has yet to be established because existing laws lack mandatory and punitive provisions, resulting in limited legal effectiveness. The Chinese government has been intensifying efforts to enhance environmental legislation. However, significant room remains for improvement, particularly in regulating the recycling of used electric vehicle batteries. This research provides an in-depth analysis of new energy vehicle power batteries, explores development directions that align with China’s national conditions, and formulates legislative recommendations. The research posits that to genuinely and effectively address the issue of recycling new energy vehicle power batteries, environmental safety must be prioritized, a complete and orderly foundation must be established, reasonable recycling obligations should be assigned to consumers, and an extended producer responsibility system should be implemented.
