Abstract:
The NSW Land Acquisition (Just Terms Compensation) Act 1991 makes provision for compensation for the acquisition of land, including any native title rights and interests in relation to land, which may include compensation for cultural loss by indigenous groups. Cultural loss may arise in many forms such as travelling over and camping, hunting, gathering and fishing and conducting ceremonies and rituals on the acquired land and the loss of the ability to look after and speak for culturally significant sites and areas. The paper outlines the findings of a research project to identify and classify forms of cultural loss and to develop a process and valuation method for quantifying compensation.
