New Zealand Superannuation and Overseas Pensions: Issues and Principles for Reform

Abstract: This paper focuses on New Zealand Superannuation and overseas pensions. The first part of this Working Paper sets out and analyses existing policy and legislation, determining the treatment in New Zealand of overseas pensions, and the treatment of New Zealand Superannuation overseas. The next section describes private complaints brought to the Human Rights Commission, Members Of Parliament, Government Ministries and the Retirement Policy and Research Centre. It uses these foundations to discuss suitable principles to guide future decision making and policy formation in this area. The final section of the first part of the Paper provides two possible options for addressing the problems identified around pension portability. The second part of the Working Paper provides supporting material, including extracts from relevant legislation and court cases, and outlines of New Zealand’s reciprocal Social Security Agreements.
