Abstract: The NHS embodies the statutory package of health care services and is subject to a considerable quantity of legislation, regulation and guidance. We provide an overview of the benefit basket in England, clarifying the actors and decision making framework involved by describing the principles underpinning the NHS, legislation on and the regulatory framework for health care, the regulation of clinicians and the key health care policies that impact upon patient ‘entitlement’ to services. We also describe services excluded from the basket. A table summarising the findings is presented in the Appendix (Table 9).
