Abstract:
The execution of Showkat Ahamad Kataria in 2006 by Jammu-Kashmir army raised serious concerns about the special powers given to army and fake encounters. The case of Kataria’s execution became a symbol of thousands of extrajudicial executions in India. The review presents the example of Nepal before India. Nepal also experienced the army domination under the Monarchy and people were tired of it. Through the elections citizens of Nepal overthrew the regime and emerged as a Democratic state. Thus India as an old democracy can learn and take some measures to curb the violence by army.
