On the Condition of Rightness of Democratic Choices in a Conventional-Spontaneous Order

Abstract:
Our purpose is to investigate the normative content of democratic choices,in a spontaneous society. Conditions of rightness are obtained. They shap e a s stem of natural law as a local public good. The corresponding socialorganization is that of nearness societies, in the geographical space as well as in the space of preferences. Humean sympathy ensures homogeneous preferences; it prevents free-riding and rent-seeking as well. In this context, evolution bridges the gap between the 'is' and the 'ought'. However, attemps to enlarge the scope of such societies would require a formal contractarian order. The latter would have to define what rightness a prior means.
