Abstract:
In its decision n°09-D-06, the French Competition Agency fined SNCF and Expedia Inc. for several anticompetitive behaviours in the online journeys selling sector. As an implicit enforcement of the essential facilities doctrine, two notified complaints relative to a potential abuse of dominance sound particularly interesting. On the one hand, this article aims at analyzing if the decision is relevant and consistent with the French and European case-laws. On the second hand, we ponder the effectiveness of SNCF's commitments to match anticompetitive concerns and to create favorable conditions for the emergence of new players in the relevant market.
