Abstract:
De jure standardization on the one hand and patents on the other hand are both crucial mechanisms for innovation development. For many years, their relationship in telecommunication committee is essential, in order to construct interoperability and mobile standards. The aim of this paper is to show the tense relations between standards and patents. We put in light the whole behavior of private actors, and the strategic use of IP in standards. We focus on legal behavior on FRAND conditions, and the use of injunctive reliefs.
