Abstract: The dieselgate is one of the most spectacular corporate scandals over the last decades, here involving the car industry, and foremost its word leader: Volkswagen. Contrary to other corporate scandals, this company was heavily sanctioned for having subverted the environmental norms on its diesel vehicles. In this paper, based on a comprehensive study of the judicial process both in Us and in Europe, we highlight the latent conflict between legal standards and managerial norms. Through the study of the game around environmental standards, we analyze the tactics used by car manufacturers to subvert these legal standards. Such a game can be assimilated to a management of illegalisms that prevails between regulators and regulatees. We stress that these deviant behaviors could be twarted because an exceptional judicial dispositif has been activated to establish, in a record time, the liability of Volkswagen. We conclude by a broader discussion about the autonomization of large corporations in modern societies and about the conditions of a performative judicial action to counterbalance their power.
