What to Expect from Child Support Guidelines?

Abstract:
Since April 2010, an official guideline has been published by the French Ministry of Justice. The implementation of this guideline raises questions about the expected impacts of this public decision-making tool. First, before the beginning of the divorce procedure, a guideline contributes to reduce uncertainty and, in certain circumstances, it is likely to encourage settlement between parents. During the judicial procedure, a guideline is an instrument which may help the judges to check to what extent the child's interests are preserved, whether by fixing a child support award when the parents make a different offer or by validating or not a mutual parental offer. After the divorce, a guideline is an instrument which is likely to encourage compliance with child support orders due to the equal treatment of similar cases.
