Abstract: The company referendum has been in use for quite some time but until recently it only played a marginal role in the industrial relations system. Two recent laws have extended its remit and have given employers more leeway to resort to it, either to fill a void in the absence of staff representation or to bypass the refusal of majority labour unions to sign an agreement. The article will go over the history of the referendum within the company and then will assess the efficiency of its uses and its democratic reach.
