Abstract: En matière de responsabilité du fait des animaux, le comportement anormal d'un chien, qui caractérise son « rôle actif » dans la survenance du dommage, résulte du seul fait que ce chien, non tenu en laisse, ait couru vers le cheval de la victime et l'ait affolé, quand bien même il n'aurait fait preuve d'aucune agressivité.
