Abstract: Discrimination is a phenomenon which can relate to the market of products or to that of the factors of production. But the most significant consequences of the phenomenon are without any doubt located in the market of the factors of production and especially in the labour market. The article confronts the economic and legal approaches from a very general point of view, in the sense that it does not try to define the various kinds of discriminations found in the labour market. It attempts to show the limits and difficulties encountered by the two approaches in the definition and measurement of this phenomenon. It also underlines their differences and complementarities in designing policies to reduce discrimination.
