Abstract:
This article examines the regulation of the nursing home (Ehpad) sector in the light of the COVID-19 crisis. It is based on an investigation carried out through semi-structured interviews in a particular region of France with the sector's public regulators and with the management and other employees of eight establishments. We show that in the first three weeks of the COVID-19 crisis, the public supervisory bodies in the region under investigation (the regional health agency (ARS) and departmental councils), caught up applying routine administrative, managerial, and standardized regulations, first failed in their duties and then lost coherence, leading to a situation of radical uncertainty for the Ehpad's management and other staff. In the absence of stable, dependable public regulation, the Ehpad all set up a "system D" based on informal, territorial networks. Subsequently, the ARS and the Ehpad re-established a joint and personalized regulatory system, taking into account the needs of the establishments, which sector actors would have liked to make permanent.
