Abstract:
If starting a business is one thing, facing its failure is another. The aim of this article is to understand how small business owners cope with this situation, focusing particularly on those who file for reorganization with the commercial court. My approach is twofold: I analyze how the business owners present their case and I examine how these defenses are received by the judges. Based on a mix-methods research, I show that filing for reorganization is not just a matter of numbers but also requires the performance of certain soft skills during the hearing. As a result, judgments distinguish between «good» and «bad» small business owners.
