Abstract:
A reform of tort law is under way in France since March 2017. One of the important aspects of this reform concerns the apportionment of liability when the damage is caused by several tortfeasors. This paper offers a theoretical and experimental literature review of joint liability rules. It states that the efficiency of a liability sharing rule depends on the nature of causality, on the liability regime, and on the information held by the judge. The theory and the experimental evidence which rely on different types of accident and on different kinds of liability rule highlight the importance to establish an apportionment of the damage as a function of the contributions to this damage.
