Abstract:
The empirical basis of Land-Use conflicts is provided by courts rulings in seven French departments, from January 1981 to July 2003. A lexical statistical analysis of decisions of the cours d'appel, Cour de cassation, cours administratives d'appel and Conseil d'Etat allows to conclude that speficic territorial patterns of conflictuality prevail. These specificities relate to three broad issues : the actors of conflits, the rationale of their actions in courts, and the rules of law that are mobilized. The contribution intends to show that courts decisions, notably those ruled by administrative tribunals, provide useful insights into land-use conflicts ; it also puts to the fore the thesis that administrative law provides an channel through which oppositions to changes of land-uses are given a voice.
