Abstract:
Territorial development can be considered as a muldimensional process in which individual and collective preferences for land-use and allocation of local resources are confronting. The paper scrutinizes what can be learned from litigation before civil and administrative courts in the field of development related land-use conflicts. The focus is put on two French administrative territories : Isère and Puy de Dôme. Some broader key elements concerning other departments are provided. Section 1 explicits the methodology and empirical legal materials used. Section 2 draws some theoretical conclusions from the empirical analysis of administrative litigation.
