Aux origines de la propriété scientifique: auctorialité scientifique et propriété intellectuelle au XIXe siècle

Gabriel Galvez-Behar

Post-Print from HAL

Abstract: From the 19th century, economic ownership of scientific discoveries are at the heart of some legal considerations and of some scientists' practices. As a starting point of a larger project, this paper seeks to analyze some relationship between scientists and intellectual property. Analysis of controversies concerning the right of priority reveals that they were motivated both by considerations concerning the development of knowledge and the desire to see the work of scholars recognized. The claim to recognition were based on arguments, which were similar to those that legitimized at the same time the intellectual property. Thus the other two parts of this paper are devoted to uses of copyright and patent by scientits.
