Abstract:
A combination of survey and quantitative data is used to estimate the extent of trademark infringement and to examine whether the variables prominent in the theoretical literature are statistically useful in explaining the enforcement strategies of imitated firms. Compared to the previous empirical studies in the field, this dataset presents several distinctive features regarding the measurement of enforcement strategies and the type of independent variables. Most of the intuitions developed by the theoretical literature are confirmed but I also find that a large market share reduces the probability of enforcement while a large size confers a very significant advantage in out of court negociations.
