Abstract:
The originalism that has been developing in American case law since the 1970s aims to base court rulings on the search for the legislator's intention from the original meaning of the Constitution. While originalism aims to reduce judicial discretion and thus ensure consistency and predictability of decisions, it is often seen as carrying a socially conservative and economically pro-market bias. The article shows how different variants of originalism have effectively led to a constitutional basis for reduced federal economic interventionism and pro-market policies.
