Abstract:
Two fundamental characteristics of competition policies are the goals assigned to competition rules and their implementation procedures. Through their respective dynamics, they draw different competition policy models. The increasing importance given to the rights of defence in European law and the convergence towards an effects-based approach are the main trends which this article aims to assess, not only with regard to their respective impacts, but also with regard to the current challenges posed by more regulatory interventions and more holistic objectives.
