Abstract:
Assessing the course of American competition policy at the end of the first year of President Trump's second term is no simple task, for conflicting tendencies run through it. One theme, however, persists: antitrust conservatism. In a paradox, this conservatism echoes the progressivism it succeeded in its scepticism toward effects-based analysis. Yet moving away from an assessment of competitive effects risks producing arbitrary decisions.
