Convient-il de breveter les gènes ? Une analyse économique

Claude Henry

Working Papers from HAL

Abstract: The costs, in terms of inhibiting further research and innovation, of patenting genes, are larger than the benefits, in terms of added incentives to the effort of identifying genes ; it is thus economically detrimental to patent genes. For those which are already patented, compulsory licensing should be viewed as analogous to regulating the access to essential facilities in network utilities.
