Abstract:
Against a backdrop of growing incivism in road traffic and limited incentives for the emergence of rules, the economic analysis of law was called upon. More precisely, Peltzman's (1975) observation served as a means of verification with factual observations and empirical data on helmet wearing and the use of speed bumps in road traffic in the city of Ouagadougou in Burkina Faso. It emerges that the damage and, in particular, the perverse effects resulting from these preventive measures are objectively, economically and technically far from negligible, in line with Calabresi's (1970) principle of minimization. Hence, a combination of technical measures, awareness-raising and sufficiently dissuasive repressive measures presents itself as a better second-best optimum.
