Abstract:
Even if the Digital Market Law is built based on the decisional practice of competition law, its purpose and its operating rules differ very significantly from antitrust law. It is not about sanctioning practices after demonstrating a net negative effect on consumer welfare, but about imposing ex ante rules on certain economic operators to guarantee the contestability of the positions acquired by the major digital ecosystems and to ensure fair competition within them. This contribution proposes to put the genesis of this law in perspective with the American FTC Act of 1914 and to consider the articulation between the rules it introduces and the application of competition rules.
