The effect of Regional Law 35/2011 on strategic public works

Abstract: The Tuscan Regional Law No. 35/2011 sets the criteria for identifying which public works within the region are of strategic interest. In addition, it provides for a number of obligations aimed at ensuring more accountability on the contractors part, especially in what concerns the monitoring and scheduling of works. The paper is based on data from the regional administration’s monitoring archive and the archive of public work projects started in Tuscany (SIMOG-SITAT), and has a twofold aim. The first is to estimate how faster is the progress of the works subjected to law as compared to a set of similar but unmonitored public works. The second aim is to analyze the execution times of works, making use of the statistical techniques of survival analysis, following either a “descriptive” or a “cause-effect” approach. The descriptive approach allows to quantify the potential advantage-“average” time deriving from monitoring, other characteristics of the works and the factors influencing time but ascribable to contractors being equal. The cause-effect approach is more ambitious as it seeks to identify more rigorously the execution times settled by law by applying the regression discontinuity analysis, still taking into account the influence factors on the contractors’ part. The results obtained using both approaches agree that the activities under Law 35/2011 lead to the speeding up of works.
